Health Guarantee and Sale Contract

Sale Contract:

The following agreement constitutes a binding contract between Brooke Bruce, hereafter referred to as “Breeder,” and _______________________, hereafter referred to as “Purchaser,” for the sale and purchase of one Goldendoodle puppy, hereafter referred to as “Puppy.”

In consideration of a purchase price of $1500, of which $500 is a non-refundable deposit, Breeder agrees to transfer all rights, privileges, and responsibilities associated with ownership of a Puppy of the Goldendoodle breed to Purchaser after Puppy has reached the age of 8 weeks. This represents the entire agreement between Breeder and Purchaser in an outright sale and payment is to be made in full before Puppy leaves the Breeder’s premises.

In the event that the Purchaser gives the Breeder fake money and/or the funds are disputed and withdrawn from Venmo, or any other electronic form of payment, the Purchaser will be responsible for any NSF or other fees charged, and the Puppy will be returned to the Breeder immediately with no reimbursement of expenses to the Purchaser.

Health Guarantee:

  • All puppies are successfully weaned from the mother at the time of transfer.
  • All puppies are up to date on shots and deworming medications.
  • All puppies have been thoroughly examined by a veterinarian and will go home with vet record(s).

Health Warranty:

  • Breeder warrants Puppy to be in good health and free from illness at the time of transfer to Purchaser. 
  • Puppy will have at least one examination by a qualified veterinarian and will receive appropriate worming and vaccinations at the Breeder’s expense.
  • Breeder requires Purchaser to have Puppy examined by a veterinarian of Purchaser’s choice within 72 hours of transfer of Puppy at Purchaser’s expense or the health guarantee portion of this contract will be null and void.
  • In the event of emergency of any genetic or congenital disorder within Puppy’s first 12 months of life which is sufficiently serious in the opinion of at least two qualified veterinarians, one of whom will be selected by Breeder, to deem Puppy unsuitable as a companion pet or to warrant euthanasia of Puppy, Breeder agrees to:
  1. Replace Puppy with one of equivalent quality and value within 18 months or, at Breeder’s option,
  2. Refund the original purchase price. 

In either of these cases, Puppy must be relinquished to Breeder. Return shipping, veterinary and testing expenses, and other costs associated with replacement Puppy are the responsibility of the Purchaser.

If the Purchaser chooses to keep defective Puppy. Breeder will refund 50% of the original purchase price listed on this contract. Choosing this option deems the health guarantee portion of this contract null and void. Purchaser must, in any of these circumstances, willingly and openly provide documentation of tests performed, supporting veterinary reports, and veterinary contact information to Breeder at Breeder’s request.

  • Purchaser understands that allowing puppy to become overweight, over-vaccinated, or failure to provide puppy with adequate diet, exercise, proper veterinary care, and protection from hazards to health and development of Puppy will deem the health guarantee portion of this contract null and void.
  • Death due to injury, accident, owner neglect, or any other cause will not be eligible for a refund. Breeder is not responsible for injuries sustained, illnesses contracted, or death during transportation.

Purchaser’s Responsibility:

  • Purchaser has 72 hours from the date of purchase to get the Puppy examined by a veterinarian for any sickness or disease. If a sickness or disease is discovered in the Puppy during that time, Purchaser can choose between the following two options:
  1. A full refund will be offered in exchange for the Puppy if the Puppy is returned within 7 days after being released by the Breeder, or
  2. Breeder will pay for medication for the treatment of any parasites, viruses and/or worms found in the Puppy, up to the purchase price of the Puppy. 
  • Purchaser is responsible for spay/neuter of the Puppy within the first 12 months or as directed by your veterinarian. Purchaser does not have breeding rights.
  • Purchaser is responsible for keeping the Puppy up to date on immunizations and deworming medications after the Puppy is brought home.
  • Purchaser is responsible for feeding the Puppy a high-quality dog food. A low-quality dog food will result in skin, ear, coat issues and, overall, poor health.
  • If the Purchaser decides he/she doesn’t want the Puppy anymore, the Puppy will need to be returned to the Breeder immediately and the Breeder will rehome the Puppy. The rehoming fee will be given to the original Purchaser when the Puppy is rehomed. The rehoming fee will be determined by the Breeder. If the Puppy is not up to date on immunizations and deworming, the Breeder will deduct the cost of a necessary veterinarian visit plus a $100 inconvenience fee from the rehoming fee. This is to ensure that the Puppy will not go to a backyard breeder, animal shelter, or puppy mill, and the Breeder can screen the new home to make sure the new owner is ready and able to raise the Puppy.

If the Purchaser does not comply with the above responsibilities listed under “The Purchaser’s Responsibility”, that would be a breach of contract.

Purchaser will be responsible for any legal/attorney fees if legal action needs to be taken in order to enforce the terms of this contract, and all legal proceedings will take place in the Breeders parish.
